Breaking: Amazon Legally Confronts FTC, Denies Monopoly Charges in New Lawsuit

Amazon has moved to dismiss the Federal Trade Commission’s (FTC) antitrust lawsuit against it. The FTC and 17 state attorneys general sued Amazon in September, alleging that the company engaged in allegedly unfair monopolistic practices against competitors and consumers. In response, Amazon argues that the FTC has failed to provide evidence that its practices raise prices or harm consumers.

The FTC’s lawsuit alleges that Amazon has used illegal tactics to crush competition. These tactics include pushing back sellers who list their products at better prices elsewhere in search results and forcing sellers to use its fulfillment service based on Prime availability. Amazon also reportedly used an algorithmic tool called “Project Nessie” to inflate prices between 2016 and 2018, totaling more than $1 billion.

Amazon’s motion to dismiss states that the company only engages in “common retail practices that benefit consumers and are the essence of competition.” Amazon lawyer Heidi Hubbard states that the lawsuit “illogically and irrationally assumes that Amazon’s efforts to keep prices low, which are prominent on Amazon, increase consumer prices across the entire economy.”
