EU’s New Artificial Intelligence Rules Transform the Industry

As the Artificial Intelligence sector grows, scrutiny over how companies obtain and use data for training models intensifies.

New laws regulating artificial intelligence (AI) in the European Union (EU) are compelling companies to become more transparent about the data they use to train their AI systems, revealing one of the industry’s most closely guarded secrets.

Impact of the New AI Laws

In the 18 months since Microsoft-backed OpenAI introduced ChatGPT, there has been a surge in public interest and investment in AI applications capable of generating text, images, and audio content. However, as the sector has expanded, questions have arisen regarding the sources of data used to train these models. Concerns about potential copyright infringement have been highlighted, especially when AI companies use best-selling books and Hollywood movies without the creators’ permission.

The EU’s newly adopted Artificial Intelligence Law introduces phased regulations over two years, obliging businesses to adapt to new transparency requirements. One of the law’s more controversial aspects is that organizations using general-purpose AI models, such as ChatGPT, must provide “detailed summaries” of the content they use for training. This requirement aims to ensure transparency but also poses challenges for companies that consider their training data proprietary.

Transparency and Trade Secrets

A newly established AI office plans to publish a template for these transparency reports after consulting stakeholders, expected in early 2025. However, the specifics of these rules are still unclear, leading AI companies to hesitate in disclosing their training data, which they view as trade secrets. Matthieu Riouf, CEO of AI-powered image editing firm Photoroom, highlighted the competitive risks, comparing it to chefs unwilling to share secret recipes.

Implications for AI Companies

The level of detail required in these transparency reports will have significant implications for both small AI startups and major tech companies like Google. These companies have centered their future operations around AI technology, and the new regulations could impact their competitive edge.

As AI continues to develop, the balance between innovation and regulatory compliance will shape the industry’s future. The EU’s AI regulations are a critical step in ensuring responsible AI development while addressing the ethical and legal challenges posed by the use of vast amounts of data.
