TikTok Sued in the US Over Children’s Privacy Concerns

The US Department of Justice plans to file a lawsuit against TikTok, focusing on allegations that the popular social media platform violates children’s privacy rights.

The lawsuit centers on claims that TikTok has breached privacy rights specifically related to children, rather than misleading adult users about data privacy practices. This move follows an investigation by the Federal Trade Commission (FTC), which referred the case to the Department of Justice earlier this week.

Investigation Details

The FTC’s investigation identified potential violations by TikTok and its parent company ByteDance. “The investigation found reason to believe that the named respondents have violated or intend to violate the law and that a transaction is in the public interest,” the FTC stated. The investigation initially stemmed from a 2020 report by Reuters, which highlighted concerns that TikTok failed to comply with a 2019 settlement designed to protect children’s privacy.

TikTok’s Response

TikTok has expressed strong disagreement with the FTC’s allegations and disappointment over the decision to pursue a lawsuit. Furthermore, the company maintains that it has adhered to the privacy agreement and denies any wrongdoing.

Separate Concerns

This lawsuit is distinct from other ongoing concerns about the potential for the Chinese government to access data from TikTok’s 170 million US users without authorization. TikTok has consistently denied these allegations. Furthermore, TikTok is currently challenging an April law that mandates its Chinese parent company ByteDance to divest TikTok’s US assets by January 19, or face a ban. ByteDance argues that such a divestment is “not technologically, commercially, or legally feasible.”

Implications

This legal action highlights the increasing scrutiny social media companies face over data privacy, particularly concerning younger users. The outcome of this lawsuit could have significant implications for TikTok and other platforms regarding how they handle user data, especially for children.
